Welcome to the coven of Shadow Alchemy. These Terms & Conditions govern your access to and use of the Shadow Alchemy web pages, exercises, and related content provided by Tarotsmith (‘we’, ‘us’, or ‘our’). By accessing or using any part of Shadow Alchemy, you agree to abide by these Terms in full. If you do not agree, you must cease all use immediately.
1. Acceptance of Terms
1.1 Binding Agreement. These Terms constitute a legally binding contract between you (‘you,’ ‘User,’ or ‘Initiate’) and Tarotsmith. They govern your access to all Shadow Alchemy content, including but not limited to Quick-Start guides, Practice Exercises (–22 through –1), Core Curriculum (1 through 31), and any related downloadable materials.
1.2 Modifications. We reserve the unilateral right to modify these Terms at any time. Material changes will be announced via in-site notice. Continued use after such notice constitutes acceptance of the revised Terms.
2. Eligibility & Access
2.1 Age Requirement. You must be 18 years or older (or the age of majority in your jurisdiction) to use Shadow Alchemy. By using the site, you represent that you meet this requirement.
2.2 Voluntary Participation. All engagement with Shadow Alchemy is voluntary. You acknowledge that exercises may evoke strong emotional responses, and you assume full responsibility for self-care and personal safety.
3. License & Intellectual Property
3.1 Ownership. All text, graphics, logos, images, audio, video, and other materials (‘Tarotsmith Content’) are the exclusive property of Tarotsmith or its licensors.
3.2 Limited License. Tarotsmith grants you a limited, revocable, non-exclusive, non-transferable license to access and use Tarotsmith Content solely for your personal, non-commercial use in accordance with these Terms.
3.3 Prohibited Uses. You agree not to reproduce, distribute, modify, create derivative works from, publicly display, or exploit Tarotsmith Content without our express written permission.
3.4 User-Provided Content. Any content you create or submit (‘User Content’) remains yours. By submitting it, you grant Tarotsmith a worldwide, royalty-free, perpetual license to use, reproduce, and display that content in connection with the site and promotional materials. You represent that your User Content is original or that you have the necessary rights to grant this license.
4. Acceptable Use
4.1 Conduct. You agree not to use Shadow Alchemy to upload or transmit unlawful, threatening, abusive, defamatory, libellous, obscene, or otherwise objectionable content.
4.2 Professional Advice. Shadow Alchemy is a self-help and occult framework. It is not professional medical, psychological, legal, or financial advice. Always consult a qualified professional for specific issues.
4.3 Privacy Notice. Any personal reflections you record remain your responsibility. Tarotsmith does not guarantee confidentiality or encryption for user notes; you acknowledge the limits of online privacy.
5. Disclaimers & Limitation of Liability
5.1 No Warranty. ALL CONTENT IS PROVIDED ‘AS IS’ AND ‘AS AVAILABLE,’ WITHOUT ANY WARRANTY OF ANY KIND.
5.2 Risk Assumption. Shadow work can unearth intense emotions. You assume all risks associated with self-guided psychological and spiritual exploration.
5.3 Limitation of Liability. TO THE MAXIMUM EXTENT PERMITTED BY LAW, TAROTSMITH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SITE.
6. Indemnification
You agree to indemnify and hold harmless Tarotsmith, its officers, directors, employees, and agents from any claims or liabilities arising from your use of the site or violation of these Terms.
7. Termination
7.1 By You. You may discontinue use at any time without notice.
7.2 By Us. We may suspend or terminate access for any reason, including breach of these Terms, without prior notice.
7.3 Survival. Sections 3 (License & IP), 5 (Liability), 6 (Indemnification), and 8 (Governing Law) survive termination.
8. Governing Law & Dispute Resolution
8.1 Governing Law. These Terms are governed by Illinois law, without regard to conflict of law principles.
8.2 Dispute Resolution. Any dispute shall be resolved by binding arbitration in Chicago, Illinois, under the rules of the American Arbitration Association. Judgement upon the award may be entered in any court.
9. Miscellaneous
9.1 Entire Agreement. These Terms constitute the entire agreement between you and Tarotsmith regarding Shadow Alchemy.
9.2 Severability. If any provision is invalid, the remainder remains enforceable.
9.3 No Waiver. Failure to enforce any provision shall not constitute a waiver.
